1. Acceptance of Terms

Welcome to Auffr (“we,” “our,” “us”). By accessing or using our website at https://auffr.com (the “Service”), including registering an account, submitting links, or browsing discovered links, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you may not use the Service.

These Terms apply to all users (“Users,” “you”), including unregistered visitors who view public content and registered members who submit or discover links.

2. Eligibility

You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to register an account or submit links. By using Auffr, you represent that you meet this requirement. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

3. Account Registration and Security

  • Accuracy: You agree to provide accurate, current, and complete information during registration and to update it promptly if changes occur.
  • One Account: You may not create multiple accounts or register on behalf of another person without permission.
  • Security: You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately at security@auffr.com of any unauthorized use.
  • No Transfer: You may not sell, transfer, or share your account with any third party.

4. Submitting Links – User Content

Auffr allows registered users to submit URLs (“Links”) along with optional titles, descriptions, tags, and comments (“User Content”).

4.1 Ownership

You retain all ownership rights to the Links and metadata you submit. However, by submitting User Content, you grant Auffr a non-exclusive, worldwide, royalty-free, perpetual license to host, store, display, reproduce, modify (for formatting purposes), and distribute your User Content as part of the Service.

4.2 Prohibited Content

You may not submit Links or User Content that:

  • Infringes any third-party intellectual property rights (copyright, trademark, trade secret).
  • Contains malware, phishing sites, viruses, or any harmful code.
  • Promotes violence, hate speech, harassment, or discrimination.
  • Includes illegal pornography, child sexual abuse material (CSAM), or any content illegal in your jurisdiction.
  • Facilitates human trafficking, terrorism, or other violent crimes.
  • Is spam, misleading, deceptive, or artificially inflates link popularity.
  • Violates any applicable local, state, national, or international law.

Auffr may automatically or manually review submitted Links for compliance. We reserve the right to reject, remove, or hide any Link or User Content at our sole discretion without prior notice.

4.4 No Endorsement

We do not endorse, verify, or guarantee the accuracy, legality, or safety of any third-party website linked from Auffr. You access external links at your own risk.

5. User Conduct

You agree not to:

  • Use Auffr for any illegal purpose or in violation of these Terms.
  • Interfere with or disrupt the Service (e.g., DDoS attacks, excessive automated requests, scraping without permission).
  • Attempt to bypass any security or rate-limiting measures.
  • Impersonate any person or entity, or falsely state your affiliation.
  • Collect or harvest other users’ personal data without their consent.
  • Reverse engineer, decompile, or extract the source code of the Auffr platform.

6. Discovery Features and Recommendations

Auffr may provide personalized link recommendations, trending feeds, or algorithmic sorting based on your activity and submissions. These features are provided “as is” and may not always reflect your interests. We do not guarantee that you will find any particular link or that recommendations will be error-free.

7. Intellectual Property Rights

7.1 Auffr’s Rights

All content on the Auffr platform excluding User Content (e.g., code, design, text, graphics, logos, trademarks) is owned by Auffr or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our platform without explicit written permission.

7.2 User Content License to Other Users

By submitting a Link publicly (i.e., not marked private), you grant other Auffr users a personal, non-exclusive license to view, share, and save that Link within the Service for personal, non-commercial discovery purposes.

8. Termination and Suspension

We may suspend or terminate your account or access to the Service at any time, with or without cause, including if you violate these Terms. Upon termination:

  • Your right to use the Service ceases immediately.
  • We may delete your account and associated User Content after a reasonable period (typically 30 days), except where retention is required by law.
  • You remain liable for any obligations incurred before termination (e.g., pending disputes).

You may delete your own account at any time via your account settings.

9. Copyright Infringement (DMCA Notice)

If you believe that any content on Auffr (including a submitted Link or metadata) infringes your copyright, please send a written notice to our Designated Agent with:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material you believe is infringing (e.g., the Auffr URL containing the link).
  • Your contact information (name, address, email, phone).
  • A statement that you have a good faith belief the use is not authorized.
  • A statement under penalty of perjury that your notice is accurate and you are the copyright owner or authorized to act.
  • Your physical or electronic signature.

We will respond promptly and may remove or disable access to the allegedly infringing content. We also maintain a policy of terminating repeat infringers’ accounts.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, whether express or implied. To the fullest extent permitted by law, Auffr disclaims all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage in trade.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • Any links discovered will be accurate, reliable, or safe.
  • Defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, Auffr and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) $100 USD or (b) any fees you have paid to Auffr in the preceding 12 months (if any). Auffr currently offers free access; therefore liability may be limited to $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you to that extent.

12. Indemnification

You agree to indemnify, defend, and hold harmless Auffr and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your User Content or submitted Links.
  • Your violation of these Terms.
  • Your violation of any third-party rights (e.g., copyright, privacy).
  • Your use of any third-party website accessed through a Link discovered on Auffr.

Auffr displays Links to external websites. We do not control, endorse, or monitor those websites. Your interactions with third-party sites are governed by their own terms and privacy policies. Auffr is not responsible for any loss or damage arising from those interactions.

14. Modification of Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by email (to the address associated with your account) and/or via a prominent notice on the Auffr website at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and delete your account.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Auffr regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • No Waiver: Our failure to enforce any right or provision does not waive that right.
  • Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
